1. About these Terms

WASH AI is an AI service for the water, sanitation, hygiene and resource-recovery sectors, operated by Baobab Tech, a trading name of Mills IT Consulting Ltd., a company incorporated in Alberta, Canada under Corporate Access Number 2019455316, whose registered office is at 2836 29 St SW, Calgary, Alberta, Canada ("Baobab Tech", "we", "us", "our").

These Terms govern your use of WASH AI through any interface, including the web application and WhatsApp. By using WASH AI you accept these Terms. If you do not accept them, do not use the service.

The Privacy Policy explains how we handle personal data.

2. Tenants and institutional subscriptions

WASH AI is organised into tenants:

Public tenant: free and open to any individual who meets section 3.
Open tenants: spaces run with partner organisations that any WASH AI user can access.
Private tenants: spaces for organisations that hold an institutional subscription. Only users the organisation authorises can access them.

If you use a private tenant, your organisation's relationship with us is governed by the Institutional Subscription Terms and its Order Form. These Terms still apply to you as a user. Where these Terms conflict with the Institutional Subscription Terms or an Order Form, those documents prevail for the organisation. Your organisation manages your access and may suspend or remove it.

3. Eligibility and accounts

3.1 Age. You must be 18 or older.

3.2 Accurate information. Provide accurate registration information. Do not impersonate another person or create accounts for others without their authorisation.

3.3 Signing in. You sign in to the web application with a one-time passcode sent to your email, or with Google or LinkedIn. On WhatsApp, your account is linked to your phone number.

3.4 Account security. Keep access to your email account and devices secure. You are responsible for activity under your account. Tell us promptly at support@washai.org if you suspect unauthorised access.

4. The service

4.1 What it does. WASH AI answers questions using AI models and a curated knowledge base of sector documents. We curate the knowledge base but do not warrant that it is complete.

4.2 Not professional advice. Outputs are generated by AI and may be inaccurate or incomplete. WASH AI does not provide medical, legal, engineering, financial or other regulated professional advice. Have qualified people validate outputs before relying on them for decisions affecting health, safety, infrastructure or emergency response.

4.3 Free tier. A free tier will always be maintained so that WASH knowledge stays accessible regardless of means.

4.4 Fair use. We may apply rate limits or temporary restrictions to keep the service stable and prevent abuse.

4.5 Changes to the service. We develop WASH AI continuously and may add, change or remove features, models and interfaces.

4.6 Availability. We aim for high availability on the public and open tenants but do not guarantee uninterrupted or error-free access. Service levels for private tenants are set out in the Service Level Agreement.

5. AI models

5.1 Public and open tenants. You choose a response mode: Fast, Smart or Deep. We choose the model and provider behind each mode and may change them at any time. Depending on the model, your queries may be processed outside the EU and UK. Details are in section 5 of the Privacy Policy.

5.2 Private tenants. Your organisation's Order Form sets which models and processing regions may be used. You cannot select a model.

5.3 Training. We do not use your prompts, outputs or uploaded documents to train or fine-tune AI models, and we contract with model providers on terms that exclude training use.

5.4 Variability. Different models can give different answers to the same query. We do not warrant that any model will remain available.

6. Your content

6.1 Ownership. You retain ownership of the prompts and documents you submit. You grant us a non-exclusive, royalty-free licence to host, copy, index, process and transform them to provide the service, keep it secure and comply with the law.

6.2 Private and public documents. In a private tenant, administrators mark uploaded documents as private or public. Private documents are used only within that tenant. Public documents may be published to the shared knowledge base available to all users.

6.3 Your responsibilities. Submit only content you have the right to submit. Do not submit special category personal data (such as health, ethnicity or religious belief), criminal offence data, or personal data about children. We do not filter input for this data.

6.4 Outputs. You may use outputs for your own purposes, subject to these Terms. You are responsible for checking that your use of an output complies with the law and with the rights in any sources it references.

7. Prohibited uses

Do not:

scrape the service or extract data by automated means beyond the rate limits we permit;
copy, modify, reverse engineer, resell or sublicense WASH AI;
use WASH AI or its outputs to build a competing product or to train AI models;
generate content that is unlawful, defamatory, harassing or discriminatory, or that infringes the rights of others;
submit personal data of others without a lawful basis;
use WASH AI to make automated decisions with legal or similarly significant effects on a person without human oversight;
attempt to access other users' or tenants' data, or disrupt the service.

8. Intellectual property

Baobab Tech or its licensors own the WASH AI software, models, prompts, interfaces, documentation and the curation of the knowledge base. Third-party software, models and documents remain the property of their owners.

Knowledge-base documents are cited and linked to their sources where possible. Copyright holders can request removal of their material through the process in our Legal Notice or at support@washai.org.

9. EU AI Act

WASH AI is an AI system under Regulation (EU) 2024/1689 (the EU AI Act). It is not deployed for any high-risk use listed in Annex III. You are told that you are interacting with an AI, and AI-generated content is labelled as such, in line with Article 50. Contact us before using WASH AI in a context that may be high-risk, so that governance and human-oversight arrangements can be agreed.

10. Feedback, accessibility and translation

10.1 Feedback. You grant us a non-exclusive, perpetual, royalty-free licence to use feedback you give to improve WASH AI.

10.2 Accessibility. We are working towards WCAG 2.2 AA and the European Accessibility Act (Directive (EU) 2019/882). Report accessibility issues to support@washai.org.

10.3 Translation. WASH AI uses machine translation, which may contain errors. Have critical communications checked by a human translator.

11. Suspension and termination

We may suspend or end your access, to the minimum extent needed, if you breach these Terms, to prevent or contain a security threat, or where the law requires it. You can stop using WASH AI and ask us to delete your account at any time by writing to privacy@washai.org. In a private tenant, your organisation controls your account.

12. Disclaimers and limitation of liability

12.1 As is. To the extent the law allows, WASH AI is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

12.2 Limitation. To the extent the law allows, Baobab Tech is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill arising from your use of WASH AI.

12.3 Mandatory protections. Nothing in these Terms limits liability that cannot be limited under applicable law, including for death or personal injury caused by negligence, fraud, or non-waivable consumer rights where you live.

13. Governing law and disputes

13.1 General. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have jurisdiction.

13.2 Consumers in the EEA, UK and Switzerland. If you are a consumer habitually resident in the EEA, the UK or Switzerland, you keep the protection of the mandatory law of your country of residence and may bring proceedings in its courts.

14. Changes to these Terms

We notify material changes through the WASH AI interface or by email at least 30 days before they take effect, unless the law or security requires a shorter period. Continued use after the effective date means you accept the new Terms.

15. General

15.1 Assignment. You may not transfer your rights under these Terms. We may assign them to an affiliate or a successor to our business, provided it accepts the same obligations.

15.2 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about WASH AI. For users of private tenants, the Institutional Subscription Terms and Order Form also apply as described in section 2.

15.3 Severance. If a provision is invalid, the rest of these Terms remains in force.
